Welcome to CardPilot. By accessing or using our services, you agree to these Terms of Use.

1. Acceptance of Terms

By using CardPilot, including the Marketplace, listing tools, and related features, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Marketplace – Listing Service Only; No Liability

IMPORTANT DISCLAIMER: CardPilot’s Marketplace is a listing, matching, and communication service only. We do not buy, sell, authenticate, guarantee, insure, or take custody of any items. We are not a party to any transaction between users. All purchases and sales are solely between the buyer and seller. We make no representations about the authenticity, condition, value, or legality of any item.

NO LIABILITY FOR TRANSACTIONS: To the maximum extent permitted by law, CardPilot, its owners, operators, affiliates, and agents shall have no liability whatsoever for any loss, damage, theft, fraud, dispute, or harm arising from or related to any marketplace or peer-to-peer transaction, including but not limited to:

Loss, theft, or damage to items of any value (including high-value or collectible items);
Fraud, misrepresentation, or counterfeit items;
Payment disputes, chargebacks, or non-delivery;
Shipping errors, loss, or damage in transit;
Authentication disputes or disputes over item condition;
Any other matter arising from transactions between users.

You use the Marketplace entirely at your own risk. You are solely responsible for verifying the identity, reputation, and intentions of other users, the authenticity and condition of items, and the terms of any sale.

3. Marketplace Fees; Sale Reporting

Marketplace transactions are subject to a site fee (currently 5% buyer fee and 5% seller fee). Users who complete a transaction through the Marketplace agree to report the sale to CardPilot and to pay the applicable fee. Failure to report completed sales or to pay fees may result in suspension or termination of access.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDPILOT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

5. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Indemnification

You agree to indemnify, defend, and hold harmless CardPilot, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of our services, (b) your violation of these Terms, (c) your violation of any law or third-party rights, or (d) any transaction or dispute between you and another user.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute shall be resolved in the courts of Delaware.

8. Changes

We may modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
